MSP ethics body facing ‘significant challenges’ as backlog increases

The backlog of complaints into MSPs and councils has increased dramatically as the body which investigates them continues to face “significant challenges”, Audit Scotland has said.

Initial assessments of complaints made to the Commissioner for Ethical Standards in Public Life in Scotland are taking up to nine months, which “may affect public confidence” in the process.

In the year ending April 2022, there were 760 outstanding complaints into MSPs (22 higher than the year before) and 146 outstanding complaints about local authority figures (up 122 from the previous year).

In addition, there were 19 open cases into MSP conduct (up five) and 84 covering individuals in local authorities (up 76).

Auditor General Stephen Boyle has warned that pressure facing the commissioner’s office will continue if it is to continue to deliver its objectives and reduce this backlog.

He said: “It is concerning that the outstanding caseload increased considerably, with a knock-on effect on how quickly claims are assessed. Further funding received for additional staffing will help, but it will take time to hire and train the people needed. It is vital that backlogs are reduced to help restore public confidence.”

The commissioner’s office investigates complaints made about people in public office, including MSPs, councillors, public-body board members and lobbyists.

It received additional cash from the Scottish Parliamentary Corporate Body last year to help tackle staff shortages.

But the auditor said creating a financially sustainable governance and operational structure must be a high priority going forward.

Last year, the body was warned about “serious failings” in its governance, some of which has improved.

But while it is now considered to be on a “firmer footing”, the Audit Scotland report called for a medium-term financial plan to be implemented.
